Le Festival du Recycl’Art voit le jour à Montpellier, au Québec, en 2004, et met fin à ses activités en 2011, date à laquelle on décide de déplacer l’événement à Gatineau, dans l’espoir d’attirer un plus large public. Le défi sera, entre autres, d’obtenir le financement, de finaliser le choix de l’emplacement, de planifier les activités et de trouver un slogan.

The Recycl’Art Festival was first launched in 2004 in the town of Montpellier, Quebec, and was held there until 2011, when it was decided to move it to Gatineau to attract a wider public. The challenge was to secure the necessary funding to finalize the choice of location, plan the artistic activities, and come up with a catchy slogan.

Un incident mineur, envenimé par des problèmes de communication, affecte la relation entre une entreprise et l’un de ses clients. Un tailleur de haies de cèdres, employé par l’entreprise d’entretien paysager TailleVerte, sectionne malencontreusement une guirlande de lumières lors de la tonte annuelle. Steve Bernard, co-propriétaire de la résidence où s’est produit l’incident et membre du comité vert de sa coop d’habitation, avait pourtant proposé de tenir le fil hors de portée du travailleur ! L’accident est banal, mais aurait pu être évité, d’autant plus que M. Bernard estime la valeur des lumières à environ 900 $. L’employé responsable de l’incident indique que M. Bernard sera remboursé pour les dommages, mais le président de TailleVerte semble penser autrement. Ce dernier, Robert Anderson, répond froidement aux courriels… si même il y répond ! Même la douce et compétente directrice du service à la clientèle, Christine Rodriguez, avec qui M. Bernard a l’habitude de traiter, devient impossible à joindre. Après des mois d’attente, M. Bernard apprend que l’entreprise lui refuse un remboursement. Insatisfait de la proposition d’un maigre 100 $ de rabais sur la facture de l’année suivante, il demande à rencontrer les représentants de TailleVerte afin de négocier une entente plus juste.

A minor incident made worse by poor communication skills has embittered the relationship between Trees-R-Us, a small landscaping company, and one of its clients. A hedge trimmer employed by the company inadvertently cut through a few wires during the annual hedge trimming. Steve Bernard, co-owner of the property and member of the co-owners association’s Green committee, had offered to hold the wires out of harm’s way, but his offer had been ignored when he left to make a phone call. While it was a minor incident, it could easily have been avoided. The hedge trimmer responsible for the incident had advised Bernard that he would be reimbursed for the damage, which Bernard estimated to be about $900, but Robert Anderson, president and owner of Trees-R-Us, was unwilling to do so. Bernard had to wait months for an answer and was disappointed by its coldness when it finally arrived. Christine Rodriguez, the company’s customer service manager, had always given him good service in the past, but he was unable to reach her. Bernard was finally told that he would not be compensated for the damage but would be offered a $100 discount on the following year’s contract. Dissatisfied, Bernard had asked to meet in person with Anderson and Rodriguez to negotiate a fairer solution.

Le cas est fondé sur la négociation entre deux parties : les propriétaires d’une maison en vente et leur locataire. Alors qu’un an auparavant les propriétaires, Gabriel et Mia, avaient décidé de s’installer ailleurs et de louer leur maison familiale pour pouvoir payer l’école privée de leurs deux enfants, ils ont maintenant besoin d’un revenu supplémentaire et se résignent à la vendre malgré l’attachement qu’ils éprouvent. La locataire, Corinne, a emménagé il y a à peine un an et se voyait y vivre pendant plusieurs années. Elle a donc investi massivement dans la maison, y ajoutant, entre autres, une piscine chauffée, un climatiseur et un système d’alarme. Ce sont des dépenses exorbitantes qu’elle n’était pas autorisée à faire selon son contrat, mais qui augmentent grandement la valeur de la maison que Gabriel et Mia mettent en vente. Afin de les accommoder, elle leur propose de la dédommager de 16 500 $ pour compenser ses investissements. Ceux-ci acceptent et une entente verbale est conclue. Cependant, tandis qu’une offre d’achat est sur la table et qu’il ne reste que 48 heures pour clore la transaction, la locataire change d’avis et demande plutôt 23 570 $ de dédommagement. Les deux parties se rencontrent alors pour négocier une entente. Le cas se termine donc par une période de négociation où chacune des deux parties détient des renseignements que l’autre ne possède pas.

The case is based on a negotiation between two parties: the owners of a house being sold and their tenant. One year earlier, Gabriel and Mia had decided to buy a new house and rent out their old one, to which they were still emotionally attached, to cover the cost of private schooling for their two children; they now need extra income and have resigned themselves to selling their first home. Corinne, their tenant, moved in about a year ago and, expecting to live there for several years, had invested heavily in the house, installing a heated swimming pool, an air conditioner, and an alarm system among other things. These were major expenditures that she was unauthorized to make according to her lease, but that greatly increased the value of the house, which Gabriel and Mia are now trying to sell. Corinne had agreed to move as long as they offered her financial compensation of $16,500. They agreed, and a verbal agreement was reached. However, once a purchase offer was on the table, with just forty-eight hours to finalize the transaction, Corinne changed her mind and demanded $23,570 in compensation. The two parties have agreed to meet to negotiate an agreement, and the case ends by giving the perspective of each of the two parties.
